While some courts have characterized medical staff bylaws as a contract, and such characterization is supported by the American Medical Association and the Joint Commission on Accreditation of Healthcare Organizations, the author argues that many implications of regarding medical staff bylaws as a contract have been ignored, and that the debate about the character of medical staff bylaws is simply one over power within the hospital.
